1. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You may not use our services to engage in any activity that could harm AI Jumpstart, our clients, or the public. This includes, but is not limited to, spamming, distributing malware, or attempting to reverse-engineer our systems.

2. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and up-to-date information and to promptly notify us of any unauthorized use of your account.

3. Intellectual Property

All content, tools, designs, and software provided by AI Jumpstart are the property of AI Jumpstart or its licensors. You may not copy, modify, distribute, or resell any part of our services without our express written consent.

4. User Content

You retain ownership of the content you upload or submit while using our services. By doing so, you grant us a non-exclusive, worldwide license to use your content solely for providing, maintaining, and improving our services.

5. AI Output and Disclaimer

AI-generated outputs are produced algorithmically based on user input. We do not guarantee the accuracy, completeness, or appropriateness of these outputs. Use of AI-generated content is at your own risk and should be reviewed before use.

6. Payment, Billing, and Usage

All fees, including onboarding and monthly subscription, must be paid using an approved payment method. Usage-based features (e.g., SMS, phone AI, email volume) may incur additional charges. It is your responsibility to monitor your usage and associated fees.

7. Cancellation and Data Deletion

You may cancel your subscription at any time through our billing portal. Upon cancellation, your access will be revoked, and your data may be permanently deleted within 24 hours. Please back up any necessary data prior to cancellation. No refunds will be issued unless required by law.

8. Refunds and Disputes

Refunds are not guaranteed and are granted solely at the discretion of AI Jumpstart. Any billing disputes must be submitted in writing within 30 days of the charge. Failure to do so waives your right to dispute.

9. Indemnification

You agree to indemnify and hold harmless AI Jumpstart and its affiliates against any claims, damages, liabilities, or expenses arising from your use of our services, your content, or your violation of these Terms.

10. Limitation of Liability

AI Jumpstart is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities. Our total liability is limited to the fees paid by you in the three months preceding the claim.

11. Modifications to Services

We reserve the right to modify, suspend, or discontinue any service or feature at any time, with or without notice. We are not liable for any resulting impact on your use or access.

12. Prohibited Use

You may not use our services to:

- Violate any laws or regulations

- Infringe on intellectual property rights

- Send unauthorized communications (spam)

- Distribute malware or harmful code

- Attempt to gain unauthorized access to our systems

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ontario, Canada. Any disputes arising from these Terms shall be resolved in the courts of Ontario. We reserve the right to opt for binding arbitration.
